1.- General Terms and Conditions of Sale
The prices of the Products are those prices specified on the price next to the product, VAT (value added-tax) is included in the prices but shipping charges are not included. We reserve the right to change our pricing policy for undelivered Products, these may be increased or decreased in the event of a change in TellusMagna’s cost, change in market conditions or any other causes beyond the our reasonable control. TellusMagna can reward with a discount to costumers on quick payment or cash payment. We decide on this discount payment or discount freely and at our own discretion.
Unless otherwise agreed to in writing by Seller, all prices quoted are exclusive of transportation and insurance costs, duties, and all taxes including federal, state and local sales, goods and services taxes, and any other taxes. Forwarding expenses will be indicated in the basket as well as in the order overview. Forwarding expenses can vary depending on the different forwarding address.
To make a purchase, the products must have been put first in the basket, and the registration form must have been filled out. Then the order with the end price of the products as well as the prospective delivery deadline must be given out, after that the payment must take place. For this, we offer two options at customer’s disposal: bank transfer or credit card payment.
According to TellusMagna’s business policy, our company can decides changes at the end result of the price, among other things such as loyalty and bulk buying discounts. However, it only comes with TellusMagna’s competence to offer this kind of discounts or cash discounts voluntary and at our own discretion, this can be never asked for or applied by the costumer.
1.3.- Delivery Dates
Delivery dates can vary according to product and place. Delivery date starts only after the reception of payment. Tellusmagna’s delivery dates are estimates only and TellusMagna is not liable for delays in delivery or for failure to perform due to causes beyond the reasonable control of our company.
If delivery delay goes beyond 7 days, the buyer can resolve the contract and get back exclusively the whole amount paid for the delivery that has suffered delay.
TellusMagna will refund the amount after the customer submits a written appeal request form, and after returning the merchandise if the merchandise has been delivered before requesting the written form to resolve the contract to our company. Besides, TellusMagna is not responsible for any loss of profits (lucrum cessans) or consequential damage (damnum emergens), direct or indirectly, the maximum liability taken up by TellusMaga will refer in every case to the value of the goods.
In case of an order cancellation on the part of the buyer, this takes over the expenses of the return.
1.4.- Terms of Payment
Purchased products must be paid when the order is fulfilled. The amount must be sent to TellusMagna through one of the available payment methods. To guarantee the security of the customer, the following payment methods are available:
- Bank transfer on the bank account indicated on the web page.
- Credit card payment with: VISA, VISA Electron, or Paypal.
Once TellusMagna checks the payment, we start to deal with the order.
After making the payment of an ORDER, TellusMagna will get started on dealing with the INVOICE and send it to the indicated address on the registration form
A copy of the delivery note on which the merchandise is specified on an itemize bill is enclosed to every delivery. The receiver commits himself/herself to checking the part number as well as the dispatch note that must match up exactly. Likewise, the receiver commits himself/herself to checking the number of items, which are specified on the delivery order, match up with the number of delivered items.
The receiver must sign the delivery note giving his/her consent to the delivery. Compliance by the receiver’s signature on the delivery note means to drop to claim damages/error or to make any type of complaint about the errors or damages impossible to be noticed in the ordered and received merchandise in the delivery.
To be able to repair any mistake in the delivery, every incident with the merchandise and packing must be documented in the delivery note of the carrier under “remarks”. Besides, TellusMagna must be informed of it within 48 hours.
The lack of observing these terms means that TellusMagna will not have any contractual liability about the concerning merchandise.
All information is indicated as best as possible and in accordance with procedure and application of our products. However, this does not preclude that the buyer could have a divergent opinion.
2.- Liability of TellusMagna
TellusMagna will answer for the lack of compliance about the provided products according to the regulations currently in force based on Consumer and User Protection as well as other complementary laws.
3.- Returns and Right to Resolve the Contract
Returning any merchandise requires the consent of both contract sides. TellusMagna accepts the return of the merchandise only if the consumer exercises his/her right to resolve within the period specified by the law. TellusMagna will accept the exercise of the above right, as long as the merchandise will be without any alteration (i.e. sealed) as at the time this was delivered and ready to sale (i.e. with the original packing, perfectly kept), and having observed the established delivery terms.
